Availability and Licenced Nurseries

Nurseries licenced by HVP to sell HV A-Series Trees

Growers and Nurseries should be aware that the varieties Hidden Valley A4, Hidden Valley A16, Hidden Valley A38 are protected by Plant Breeders Rights (PBR). It is illegal to purchase or sell A4, A16 & A38 trees without entering contractual agreements with HVP. The nurseries below have been licenced by HVP to sell these varieties to the public.

Plant Breeders Rights (PBR)

Growers and Nurseries should be aware that the varieties Hidden Valley A4, Hidden Valley A16, Hidden Valley A38 are protected by PBR. It is illegal to purchase or sell A4, A16 & A38 trees without entering contractual agreements with HVP.

For the breeder , PBR establishes exclusive commercial rights to the new variety, the registered variety name and the nominated synonym (if any). Breeders are able to decide how their varieties are marketed. Having PBR means that the breeder can receive a return on his investment for up to twenty five years (trees and vines).

Apart from civil Federal Court action to recover, by way of damages, losses incurred by infringements, intentional and reckless infringement of a breeders rights may attract a penalty of up to $50,000 for individuals and $250,000 for corporations. These penalties are intended to act as a deterrent to would be infringers. (Sections 53-57 & Section 74). Plant Breeder's Rights Act,1994. HVP has licenced the above nuersies to sell our varieties to the public. In return the nurseries include one dollar or 15% royalty (whichever is greater) that is paid to HVP. It should also be noted that the sole form of funding for the HVP Breeding Program is from royalties received from tree sales and sale of scionwood, which very often doesn't cover costs.

Some retail nurseries not listed above are also able to sell our trees. In these cases all trees will be marked with a special PBR tag which indicates that the royalty has been paid. You should only purchase trees from the nurseries listed above, or those that sell these varieties with a PBR tag on each tree.
